AGREED FINAL ORDER

*****   *****   *****   *****   *****

Introduction

This case was scheduled to be brought on for hearing before the Kentucky Alcoholic Beverage Control Board on August 4, 2005, pursuant to an Order directing the Licensee to show cause, if any it could, why its alcoholic beverage licenses should not be suspended or revoked because of alleged violations of: (1) KRS 244.085(6), Minors on premises; (2) KRS 244.080(1), Sales to minors; (3) KRS 244.120, Disorderly premises; and, (4) KRS 244.080(2), Sales to persons actually or apparently under the influence of alcoholic beverages.

Findings of Fact/Conclusions of Law

Prior to a hearing being held, the Licensee, through counsel, the Honorable Kenneth S. Handmaker, and the Board entered into a settlement agreement in resolution of the above charges.

Based upon the plea and the record herein, and being otherwise sufficiently advised, the Board finds the facts to be as set out in the Order to Show Cause.  The Board takes administrative notice that the Licensee had a prior violation of KRS 244.085(6) within a two (2) year period.[1]  The Board finds the settlement agreement to be reasonable and accepts same.  The Board further finds that this Final Order should be entered in conformity with the settlement agreement as set forth below.

1.                  Retail Beer License No. 059-B-504, Retail Drink Liquor License No. 059-LD-143, Sunday Drink License No. 059-SD-926, and Supplemental Bar Licenses Nos. 059-SBL-618, 619, 620, 638, 731, and 732, issued to Midwest Restaurant Properties, Ltd., d/b/a, Yucatan Liquor Stand, are suspended for a period of seventy-five (75) days.
